Generally good legal advice everyone should keep in mind: 1) you have no obligation to talk to police without an attorney present. To invoke your legal rights, when asked questions by the police, you must say I want an attorney present. You can’t expand. You can’t kind of say it. It has to be explicit. That’s it. Don’t say anything more. Hard stop. No more talking. 2) police and detectives are allowed to lie to you or lead you on to try to get you to talk. Anything you say... can and WILL be used against you. Even if you’re arrested for an innocent reason or your wrongly arrested, you should be EXTREMELY careful about what you say. They can contort your words in court and charge you with things, completely out of context. I’d hope this wouldn’t happen to you and I’d hope charges would get dropped, but you never know. Be safe. 3) take a mental note of when you were given your Miranda warnings (aka you are under arrest anything you say can and will be used against you, you have the right to an attorney, etc.). Was it after you said some things? Was it after you were cuffed? Did they clearly say it? That will be relevant for your attorney later on. 4) write a phone number for a friend on your arm in two spots: first a spot that is covered by your clothes and second a spot that is easily accessible. Give that friend your date of birth, your current address, and your full legal name, in case they need to help bail you out or find someone who can. 5) just because you’re arrested doesn’t mean you will be charged. If you did nothing wrong, you can fight it later. Remain calm and comply with officers orders as much as you can while being arrested to try to avoid more pain and retaliation. I can’t promise that your calm behavior will be reciprocated, but it’s the best you can do in that moment. 6) don’t say anything. Again refer to #1 above. 7)when you see someone being arrested and you can safely do so, get the full name and date of birth of the person being arrested. Record the arrest from a safe distance on your phone. You have a right to do so. Keep yourself safe. 8) put a lock screen on your phones, preferably 6 digits or more, take off your face recognition and fingerprint capability, and consider if you want to deactivate your location services on your phone. You can be tracked, and police can ask to look in your phone or take your phone and try to do it themselves. It may be a 4th amendment violation because police need a search warrant to look at your phone. Just think this through before you go out there. These are just some tips. Stay strong out there.
