Digital Assets part 2 -- How can you protect them? Your digital assets have value to you, and they will have ever increasing value to your family in years to come. So, ask yourself have I made provisions to protect them and the record they represent about my life? The way to protect your digital assets following your incapacity or death would be to empower an agent (or executor or trustee) to access and to control them. There are three areas in a Will or Trust where digita...l assets could potentially be addressed. That includes the definition section, the disposition of assets section, and the personal representative, executor or trustee’s power section. To protect invaluable digital assets, make sure your documents identify them and grant powers to protect them. Likewise, your durable Power of Attorney should authorize your agent to handle your digital assets too. Identifying digital assets and providing specific authority to others to act on your behalf will help ensure that invaluable images and memories are not lost for future generations.

What are Digital Assets? In essence, digital assets are electronic records in which you have a right or an interest. Some examples of digital assets are illustrations, photographs, pdfs, documents, and even social media accounts & on-line reward programs. Digital assets may have value, or they may even be invaluable. If you use social media, could it a really be considered an electronic record of the significant feelings and events of your life? Assuming so, do you value those images and want to protect them?
