The factual record, based on the grand jury investigation that led to the charges, and the findings of the National Transportation Board (NTSB), left no doubt that the criminal defendants attempted to beat an accurately forecasted, potentially ferocious storm instead of canceling the trip and giving refunds to the passengers. - Andrew Duffy, Partner Saltz Mongeluzzi & Bendesky, P.C. #duckboat #DuckBoatTragedy #duckboatsdeathtraps

"If you give companies blanket immunity, you remove the financial incentives for them to make things safe." - Robert Mongeluzzi, Founder Saltz Mongeluzzi & Bendesky, P.C. "There are people who argue that companies shouldn't need a financial incentive to make good decisions. I agree. But we don't live in that world," added Mongeluzzi, who is representing the family of Enoch Benjamin in their suit against JBS. "Companies cut corners, maximize profits, put money over safety, and... maim and kill people every single day." "The pandemic has created more reason for businesses to take precautions, not less, Mongeluzzi said." "The more dangerous the thing you're engaged in, the more care you need to take...But their argument is, 'We may kill so many people that it becomes too expensive.'" - Robert Mongeluzzi #COVID19 #coronavirus #workplacesafety

#TipTuesday: Getting the right attorney can make a significant difference in your legal case. Early retention of an attorney will ensure you have someone there to secure evidence, put parties on notice and start accident investigation while evidence is still in place and witnesses can still be located. ... The defendants killed these victims by breaking the law and failing to have a roving night watch whose job was to prevent the very catastrophe that occurred. - Robert Mongeluzzi, Saltz Mongeluzzi & Bendesky, P.C. #conceptionfire #diveboat #conceptionboatfire

#TipTuesday...In Pennsylvania and New Jersey, under the Statute of Limitations, any personal injury or wrongful death lawsuit must be filed within two years from the date of the accident, injury or death. If the lawsuit is filed even one day after the expiration of the two-year deadline, the defendant(s) will have an absolute defense and the court will not allow the claim to proceed, regardless of how egregious the defendant(s) actions were or how severe the injuries are. Whi...le two years may seem like a lot of time, it is important to file the lawsuit as soon as practically possible. In many cases, there may be people or companies that violated their duties and responsibilities in ways that caused the plaintiff’s accident and injuries, but that are unknown or unknowable prior to filing a lawsuit. Filing your lawsuit well before the expiration of the Statute of Limitations will allow your attorneys to engage in discovery and potentially uncover responsible people or companies that were not named as defendants in the lawsuit. As long as those responsible people or companies are discovered prior to the expiration of the Statute of Limitations, they can be added as defendants to the lawsuit. If, however, the lawsuit is filed only a short time before the Statute of Limitations deadline, there may not be enough time for your attorney to conduct adequate discovery before the applicable deadline expires. After the expiration of the Statute of Limitations deadline, even if additional people or companies that were responsible for the accident and injuries are discovered, you will be unable to add them to the lawsuit as defendants. It is therefore important to file your lawsuit as soon as practically possible to allow enough time to discover other potentially responsible people or companies. The Statute of Limitations varies from state to state, and also is dependent on the type of lawsuit you are attempting to bring. Contact the attorneys at Saltz Mongeluzzi & Bendesky, P.C. as soon as possible to fully explore your options.

The Concept of Negligence May Seem Simple, But Don’t Derail Your Ability to Recover for Your Injuries Negligence is the legal term that is used to describe the basis of most personal injury lawsuits, but many people do not have an understanding of what exactly the term means. If you have been the victim of another person or company’s negligence, your lawyer must be able to prove in court that this person or company failed to take proper care in doing something that ultimately...Continue reading
