... ’ ... Yesterday we talked about the Written Statement ... and TODAY ... we talk about Video evidence .... ... One of my favorite pieces of evidence in a criminal case ... Video evidence can be : Surveillance videos from a store and/or parking lot, Video footage from cameras on a person’s home, or Even a cell phone video .... just to name a few ... The reason I love video evidence is ... you get to see how it all went down ... just like you were there when the alleged crime took place ... Isn’t that what we would love to see ....

.... In my opinion ... the Written Statement can be a very challenging pieces of evidence to deal with in a criminal case ... What is a Written Statement? ... ... Often times, after the police interview a victim/witness about an alleged crime taking place .... the police will ask that person if he/she will Write it down ... resulting in the Written Statement Here is the challenge when it comes to the Written Statement .... Once you write it down ... it’s difficult to take it back ... or change it .... Often times ... when it’s time to go to court ... an individual may say, I don’t want to testify .... or ....That’s not really how things happened .... However ... here is the challenge ... A victim/witness can be subpoenaed ... Called as a witness to the witness stand ... Asked the following question ...Did you give a written statement to the police? Obviously, the answer to that question is either yes or no .... BUT .... The prosecutor will confront the victim/witness with the written statement ... Ask him/her to read it ... And Then ... ask the question .... is that statement true or false ... ( .... / , ) .... In the end, while the written statement is definitely a challenge ... it’s the best way to know what a person may testify to at the time of trial ... ... ... With trials on hold here in Luzerne County, PA due to social distancing .... a great way to prepare for trial is to have a Habeas Corpus Hearing ... ... What is a Habeas Corpus Hearing??? Essentially ... it is a preliminary hearing before your trial Judge ... Why is have a Habeas Corpus Hearing a good idea??? 1 - It gives you the opportunity to question the witnesses again before trial ... 2 - It gives you a sense of how the trial will go .... does the evidence tend to show you are guilty or not guilty of the crime ... 3 - It gives you the opportunity to negotiate a plea and/or a sentence to help resolve the case ... Here is my Expert Trial Tip for you Today ... ... Trial Tip ... When I watch video interviews ... I not only write down the person’s answers to the questions .... I also take notes on the person’s tone of voice, any nonverbal / body language, and anything that would make the person mad, sad, or emotional ...
