Allegheny County Family Law News: Economic stimulus checks will be intercepted by Domestic Relations to pay child support arrears. The checks will be intercepted regardless of whether the arrears are delinquent or retroactive, even in cases where a request for modification has been filed. What's the difference? Retroactive arrears accumulate because of the delay from the date of filing a child support request to the date of the hearing/order. Typically parents over- or un...derpay because they don't know how much they will owe. Their order contains a plan for paying retroactive arrears over a period of months. Retroactive arrears are not grounds for contempt. On the other hand, delinquent arrears accumulate after a child support order has been issued. In other words, delinquent arrears are the result of violating a support order by under paying. Delinquent arrears are reported to credit bureaus and may be grounds for a contempt proceeding. When stimulus checks are intercepted, Domestic Relations will not distinguish between these forms of arrears. Notably, every child support payor has arrears on the first day of every month because every support order charges on the 1st day for the upcoming month. These arrears get paid down, typically twice a month, when the payroll deduction is taken and paid to Domestic Relations. So, the timing of the stimulus check might be interesting.
