So grateful to be invited onto chasing news (aired Monday) to share my thoughts on Kobe Bryant's legacy. December 1st, 2015, Kobe's first stop after announcing his retirement was the Wells Fargo Center and I had the great joy of seeing him play that day with a huge standing ovation from the 76'ers crowd. This week, instead of any criminal law information or trial tips for lawyers I thought I'd share this memory. https://www.youtube.com/watch?v=SNeUrxHY0Z4 #rememberingkobe #philadelphia #criminallaw #triallawyer #mambamentality

Topic that comes up in many conversations, directly or indirectly, did the police tell me the truth about their investigation about the evidence against me? Often the police are allowed to legally lie to a suspect under investigation unless it affects the voluntariness of a confession, but generally they face little recourse for false statements. On the other hand, in federal investigations a suspect under investigation can be charged criminally for false statements to authorities. All things to be aware of if you are under a serious investigation. For more questions on this visit my website: Criminallawpennsylvania.com

Trial topic: Mistrials in Court - how and when to ask for a mistrial and what does it mean generally for a mistrial to occur, is it good or bad for your case? This is also geared more towards practicing lawyers but I thought it would be helpful to cover some trial topics in the new year. More articles and videos at my website: criminallawpennsylvania.com

Talking today about federal sentencing and the First Step Act. Federal Court brings to mind very harsh sentencing and mandatory sentencing for most people. My appearance on #chasingnews discussing the Epstein Federal Court case, the dismissal of an action and victim impact testimony. (@ about 2:30) https://www.youtube.com/watch?v=M68uN948jys A highly unusual case, ends in a highly unusal way. This short segment was part of a larger conversation we had about procedure and the re-prosecution of Epstein after his initial plea agreement and drastic reduction of charges in Florida was re-opened by SDNY. For those really wanting to dive into legal topics and what it's like practicing law I'm writing entries in my blog about topics I find challenging, interesting, or just things I wish I had known five years ago. Here is a post about cross examining expert witnesses and your best weapon against them: https://davidhclarklaw.com//opinion-evidence-in-state-v-f/

How to show that a witness is lying in court? The ways to impeach a witness are endless whether you confront with a prior transcript of testimony or a picture of tinted windows. A trial attorney's best weapon is a variety of impeachments at their disposal for any case to show bias, motive to fabricate, or a just plain old lie. https://www.youtube.com/watch?v=m3WU9b9lBtk

New trial for Meek Mill!? How did this happen?? What's the legal rule that allows this? https://youtu.be/9jGJOqI8-e0 Superior Court in Commonwealth v. Robert Rihmeek Williams holds that after discovered evidence of police misconduct (none of this disclosed previously) was grounds for a new trial and because of additional case holdings about the need for recusal Meek Mill also gets a new judge. (Area of law PCRA - after discovered evidence)... Philadelphia is excited about this and everyone waiting to see if DA moves forward with a second trial or drops the charges. Video about how to get recourse if your case is dismissed or never goes to trial but your rights were violated. A federal statute provides a way to get your side heard in court! . . . By the plain terms of 1983, two and only two allegations are required in order to state a cause of action under that statute. First, the plaintiff must allege that some person has deprived him of a federal right. Second, he must allege that the person who has deprived him of that right ac...ted under color of state or territorial law. Gomez v. Happy Independence Day to everyone! I've been getting a lot of inquiries about what can be done after a conviction for people, federal court and other states have laws to compensate for time spent wrongly incarcerated. An on the spot question i was asked by some jiu-jitsu friends eating pizza (as i was walking my dogs). "We saw two people taking a neighbors dog because they thought it was abused. Is that Legal?" My opinion was the neighbor should be reported to the police, when appropriate, for neglect of animals (pa 5532) or reported to SPCA (https://www.pspca.org/cruelty). Otherwise animals are generally viewed as property and taking an animal could be classified as theft! https://www.youtube.com/watch?v=_oSHkbHntD4
