Harlan Schreiber Obtains Summary Judgment in the First Department on No-Fault Declaratory Judgment Action In Kemper Independence Insurance Company v. Cornerstone Chiropractic, PC, et al, 2020 N.Y. Slip Op. 03876, a No-Fault automobile insurer initiated a declaratory judgment action seeking to disclaim coverage for claims submitted by a medical provider on the ground that their alleged assignee claimants failed to sign their examination under oath (EUO) transcript and because the medical providers failed to appear for their own EUOs. Robert P. Stein prevailed on a motion for summary judgment dismissing his client with prejudice in a Bergen County auto negligence action. Mr. Stein, in conjunction with deposition testimony of the parties, secured a signed affidavit of an independent witness who confirmed the other driver disregarded a red light, traveled into the intersection at a high rate of speed, and struck Mr. Stein’s client’s vehicle as it started into the intersection on a green light. Running Miles Together Even Miles Apart: GMR Logged Miles to Support Child Advocates in the 2020 Philadelphia Bar Association Virtual 5K Run/Walk Even in quarantine the Philadelphia, New York and New Jersey offices of Goldberg, Miller and Rubin found a way to run as a team while supporting child advocates through the Philadelphia Bar Association Run. In 2019, GMR’s Bar Run team won third place and the team was looking for an even bigger victory this year but due to COVID-19, the run took place virtually with all participants submitting their individual times after running around their own neighborhoods. The team consisted of Partners, Associates, Paralegals and Legal Assistants from each of our three offices. The GMR running team looks forward to running together once again in 2021.

Marie Coronel Obtains Victory for her Clients in Essex County Slip and Fall Case Marie Coronel, Senior Counsel in GMR’s North Jersey office, prevailed on a motion for summary judgment dismissing her client with prejudice from the lawsuit. Plaintiff sued following a 2018 fall down accident in a restaurant. Plaintiff was a business invitee of the co-Defendant, a restaurant that was hosting a seminar. Plaintiff also brought suit against Marie’s client, who was hosting the event. The motion asserted that there was no negligence on behalf of Marie’s client and that the plaintiff was the cause of his fall. Judge Adubato granted the motion following oral argument.

GMR Congratulates Five of Our Attorneys Recognized as Pennsylvania Super Lawyers and Rising Stars Eamon Merrigan and Jason Rubin have been named 2020 Super Lawyers, a designation awarded to only 5 percent of attorneys in the state. Jeffrey Tenthoff, Lauren Glynn and Jessica Smeriglio were selected by the Thomas Reuters Super Lawyers search committee as Rising Stars. Only 2.5 percent of eligible attorneys in the state receive a Rising Star designation.
