We're preparing for a hearing at 230 today involving a work-related upper extremity injury. We will ask for a 30 day continuance to receive a rebuttal report from our medical expert since we just recently received the "Independent" Medical Exam report from the insurer. Also finishing a Supersedeas package for a hearing early next week- this is to stave off an attempt to terminate our client's benefits. We will be submitting an Affidavit and a medical report showing our client isn't in fact recovered and is scheduled for surgery for the work injury. Have a great, safe weekend.

Follow up with counsel on settlement offer in case involving shoulder injury. Review settlement docs just rec'd for hearing coming up. Confer with colleague about new case that just came in. Review surveillance video of client. Touch base with VP of Operations re: to do's for Lansdale office. Plan train trip for firm since prior one cancelled. Insurer issued a Notice of Denial and we still aren't sure what their defense is. We're presenting a Compromise & Release (ie, Settlement) Agreement to a Judge this morning for approval. We settled the case which involves a childcare worker who injured her knee on the job- and the insurer was alleging she could return to a sedentary position. There was a safetfy issue involved given the state our our client's post surgical progress, so we were able to strike a deal for a lump sum to close out the case.

Attended Pre Trial Hearing today before a Work Comp Judge in a case involving a work-related shoulder injury. We'll have 90 days to produce our evidence, and employer/insurer will have 90 days thereafter for their evidence. A final hearing will be April 23. Parties can request Mediation (voluntary, as mandatory mediation deemed futile at this stage) if we need assistance getting the matter resolved. If a case doesn't settle, it can take 12 months or so for a final Decision from the Work Comp Judge.
