We will ask for a 30 day continuance to receive a rebuttal report from our medical expert since we just recently received the "Independent" Medical Exam report from the insurer. Also finishing a Supersedeas package for a hearing early next week- this is to stave off an attempt to terminate our client's benefits. We will be submitting an Affidavit and a medical report showing our client isn't in fact recovered and is scheduled for surgery for the work injury. Have a great, safe weekend.

Attorney Cardamone will be cross examining a medical expert today at 1230. Case involves a work-related hand injury. The doctor, a Physical Med and Rehb phyisician, was unable to state that a work injury occurred- but if one did occur, the claimant is "fully recovered". We beg to differ.

We're presenting a Compromise & Release Agreement (Work Comp Settlement) before a Judge at 930am for approval. We take testimony from our client- the injured worker- to show the Judge that he/she understands what they're getting, what happens with medical benefits and wage loss benefits, what rights they're giving up in exchange, that they signed the document, that they did so voluntarily, that they reviewed it with their lawyer, whether there are any child support liens, or Medicare issues, etc.

Cross examined an orthopedic surgeon today who opined that our client is recovered from his low back and neck injury, sustained in a work accident. Depositions of medical experts takes a lot of preparation, studying the records, studying their reports/opinions, reviewing the record, reviewing testimony of the injured worker, reviewing the Judge's prior Decision, looking for things that don't add up, etc.

Then we have a deposition of our client in another case at 12 involving a spinal injury from a physical altercation at work where our client was trying to break it up as a counselor. Preparing for a settlement hearing tomorrow. Our client has been on work comp benefits for a few years and we struck a deal with the insurer to end the matter for a lump sum of $125,000.00. This will allow our client to get out of the system, which can be extremely stressful and demoralizing at times- dealing with erratic checks from the insurer, getting spied on, seeing the "independent" medical doctors who are hired guns with incentive to claim injured workers are suddenly recovered, etc. Settlements must be approved by a Work Comp Judge at a hearing.

Attending a status hearing this morning in a case involving a Petition to Modify (reduce) benefits based on a job offer. Client injured her right foot and ankle and cannot drive long distances- and cannot get to the job the employer offered as a result as she's still recovering post surgery.

Presenting a Workers' Compensation Settlement to a Judge at 9am in a case involving a shoulder and hand injury from our client's trash truck sanitation work. Pennsylvania Work Comp Settlements must be approved by a Judge at a hearing. The Judges aren't concerned about the amount of money at issue- that's different in each case. They are charged with the obligation to decide if the injured worker understands the full legal significance of what they are doing- what they are ge...tting and what they are giving up with the settlement. So, we go on the record and ask the injured worker questions such as: Did you read this Agreement? Did you go over it with your lawyer? Is that your signature? Did you understand it? You're going to receive X amount of money to resolve this case, correct? Medical bills from X to Y period will also be paid, if anything is outstanding- etc etc D

Settled a case today for a client who was involved in a work-related car accident, making a food delivery. We got him a lump sum payment and payment of outstanding medical bills, in exchange for a full Compromise & Release of the claim. He will still have his 3rd party case to pursue as well.

Mike here. Little summary of a small piece of my day. These are all different cases. We have to jump around constantly between cases. Prep for 2 hearings. Attend two hearings. Write up hearing memos for files. Finish Brief, upload to Judge. Update client. Deal with human resource issue with a few employees. Ask counsel for agreement to ask for additional time for Briefs/written arguments since they're due on Christmas day. Submit request to Judge. Give advice to client abou...t who is reputable 2nd opinion doctor for hand injury. Give advice to client on new doctor to see for back injury. Follow up with counsel on settlement offer in case involving shoulder injury. Review settlement docs just rec'd for hearing coming up. Confer with colleague about new case that just came in. Review surveillance video of client. Touch base with VP of Operations re: to do's for Lansdale office. Plan train trip for firm since prior one cancelled. Try to re-schedule IME exam as client cannot attend. Negotiate with Medicaid regarding lien for medical treatment paid to help get case settled. And it's just 1:15pm. This is every day. Non stop. We attended a Pre Trial hearing today regarding a Claim Petition we filed for our client who sustained a foot injury while working. Insurer issued a Notice of Denial and we still aren't sure what their defense is. We'll schedule Claimant's testimony and obtain updated medical records to then depose the treating doctor within our 90 day deadline imposed by the Judge.

We're presenting a Compromise & Release (ie, Settlement) Agreement to a Judge this morning for approval. We settled the case which involves a childcare worker who injured her knee on the job- and the insurer was alleging she could return to a sedentary position. There was a safetfy issue involved given the state our our client's post surgical progress, so we were able to strike a deal for a lump sum to close out the case.

Attorney Cardamone is proud to sponsor his nephew and godson Alex Knapp and his Lampeter Strasburg Pioneers football team- undefeated this year. Alex is a team captain and had a 72 yard TD run last night against Garden Spot. He will be attending George Mason University next year on a scholarship to play Division 1 baseball. If he doesn't go pro, he is considering law school- and we were happy to have him as an outstanding intern this past summer at Cardamone Law.

Attended Pre Trial Hearing today before a Work Comp Judge in a case involving a work-related shoulder injury. We'll have 90 days to produce our evidence, and employer/insurer will have 90 days thereafter for their evidence. A final hearing will be April 23. Parties can request Mediation (voluntary, as mandatory mediation deemed futile at this stage) if we need assistance getting the matter resolved. If a case doesn't settle, it can take 12 months or so for a final Decision from the Work Comp Judge.

Preparing for a deposition and a hearing tomorrow in two different cases. A deposition is sworn testimony, outside of a court. It's normally in our office or defense counsel's office- or in a doctor's office. The court reporter takes down everything that is said and accepts exhibits that are moved into evidence. A transcript is made and we present it to the presiding Judge. Due to the pandemic, depositions have been taking place via Zoom for the most part.
