On May 10, the Department of Homeland Security announced the revival of the Obama-era program International Entrepreneur Rule, which allows certain foreign-born entrepreneurs to stay in the U.S. for up to five years. The DHS estimates that once the program is implemented, about 3,000 foreign entrepreneurs per year would qualify, resulting in the creation of 100,000 jobs over a decade. This week, the Law and Public Safety Committee of the New Jersey State Senate advanced a bill that would bar local governments and private prisons from entering into any contracts to house or detain people for civil immigration violations, and the Department of Homeland Security announced that the U.S. will expand eligibility for Temporary Protect Status for approximately 100,000 Haitian nationals currently residing in the United States. Additionally, in a recent survey, the ...Urban Institute found that over 27% of low-income immigrant families had at least one family member who avoided non-cash benefits or other forms of governmental support for fear of possible negative impacts to their immigration status. The Department of Homeland Security has formally removed the rule that would have redefined the H-1B specialty occupations. The rule was also set to restrict the off-site replacement of H-1B employees and increase employer compliance requirements. On May 20, the USCIS issued a statement confirming that the DHS has removed the Interim Final Rule issued in October 2020, which has since been vacated by a federal district court. On April 30, a new COVID-related travel ban was implemented by the Biden administration. The ban suspended entry into the United States of nonimmigrants who were physically present in India during the preceding 14 days. The administration instituted this ban to curtail the spread of a new coronavirus variant that has caused catastrophic devastation in India. Currently, the U.S. has issued travel bans for 32 other countries. In 2000, Congress created the U visa to encourage victims of criminal activities to come forward and cooperate with law enforcement authorities, to ultimately improve public safety. This week, the White House extended restrictions on visa applications and entry into the United States for certain foreign national workers, a new rule was proposed to allow the Department of Health and Human Services to collect additional information, including DNA samples, for sponsors seeking custody of unaccompanied minors, and the policy permitting the Department of Homeland Security to deny legal permanent residency to noncitizens who lack health insurance or cannot establish the ability to pay for medical care upon admission was upheld. ICE published its year-end report, stating that the illegal, undocumented immigrants arrested by ICE during FY 2020 had an average of four criminal convictions or pending criminal charges each. According to the figures, it conducted 103,603 administrative arrests in FY 2020, 90% already with criminal convictions or charges. ICE made this announcement to highlight ICE's increased enforcement actions concerning criminal illegal immigrants. In October 2019, Martine Mbitaze had filed a complaint against the City of Greenbelt alleging that the city had refused to hire her based on her national origin and citizenship status and had engaged in document abuse in violation of 8 U.S.C. Sec. 1324b. On October 1, 2020, the Court granted summary judgment to the City of Greenbelt on the discrimination claims, but found the City engaged in document abuse in that it asked for, and insisted upon, more documents than required for Mbitaze, who is a derivative citizen. On December 23, ICE announced an extension to its remote Form I-9 verification policy through January 31, 2021. The policy had been set to expire on December 31, 2020. This extension helps employers who are working remotely due to the COVID-19 emergency to verify their new hires. The policy is effective until February 1, 2021, or within three days after the COVID-19 emergency ends, whichever comes first. According to the Green Light law, New Jersey state was scheduled to begin issuing driver's licenses for immigrants without legal documents by the beginning of January this year, but Motor Vehicle Commission officials announced that there will be a delay due to the COVID pandemic. The MVC anticipated that this law will extend driving privileges to about 450,000 of New Jersey’s approximately 500,000 undocumented immigrants. On January 18, the Free Migration Project in Philadelphia and the Austin Sanctuary Network in Texas, joined four undocumented immigrant women living in sanctuary to file a lawsuit against ICE and the DHS. The suit claims that the government unfairly targeted these four women, issuing excessive fines while they were seeking asylum and living in sanctuary in houses of worship. On December 18, the United States Supreme Court rejected a lawsuit challenging the Trump administration’s plan to keep undocumented immigrants out of the census count. This gave the administration a partial victory, which could be temporary. If the policy moves forward, it can likely be challenged again. The Supreme Court held that it was premature for this issue to be decided, given the potential issues. We are pleased to announce that the firm’s three main office locations have each participated in a holiday charity initiative as part of our commitment to the community. The firm’s Bridgewater office made a financial contribution to Fish Inc., which has served the elderly, poor, and homeless in the Dunellen area since 1970. For the last two years, the firm’s New York office has participated in The Santa Letters Project, and although the pandemic changed how, it did not change... why, so the New York office assisted in that initiative again. Then, once again, as it does each year, the Allentown office helped its neighbors at the Sixth Street Shelter, a full-service shelter for full families, women, and children. ICE is looking for detention sites that can house up to 900 detainees within a 60-mile radius of its New York City, Newark, or Philadelphia field offices, so, although the number of immigrant detainees has considerably decreased in these areas, they are considering building more immigration detention centers in Pennsylvania, New Jersey, and New York. Currently, ICE has seven detention centers in New York, five centers in New Jersey, and four centers in Pennsylvania. The American Civil Liberties Union has sued the Department of Homeland Security, U.S. Customs and Border Protection, and U.S. Immigration and Customs Enforcement over the alleged use of cellphone location data to track the location of illegal immigrants. The lawsuit comes after the ACLU had attempted to obtain more records from the government agencies, seeking clarification on how the purchased cellular data is used. A lawsuit seeking a preliminary and permanent injunction has been filed against the new Department of Labor H-1B wage rule that was announced on October 8. Employers seeking to employ foreign workers will have to pay them in accordance with the prevailing wage levels. On November 14, United States District Judge Nicholas G. Garaufis of the Eastern District of New York reinstated the DACA program. This ruling restores the Obama-era program and mandates that the Department of Homeland Security to post a public notice stating that it is accepting new applications. As a part of the application process for H1-B and other immigrant temporary workers on the path for permanent employment-based green cards, companies that sponsor them are required to show that they did not find any qualified and available U.S. workers to fill the job. On December 3, the Department of Justice announced it had filed a lawsuit against Facebook Inc., alleging discrimination against U.S. workers in the complaint that Facebook refused to recruit, consider or hire qualified and available U.S. workers for over 2,600 positions. ICE has announced the arrests of 15 nonimmigrant students through Operation OPTical Illusion. The students, who claimed to be employed by companies that don’t exist, who were found to have allegedly participated in work visa fraud to extend their stay in the United States. Under OPT, nonimmigrant students can work in their field of study for a period of one year, and students who participate in STEM programs get an additional 24 months to work in the United States. Earlier this month, DHS proposed a new rule that significantly changed immigration rules for international students in the United States. On November 30, the Second Circuit Court of Appeals upheld the Rochester Judge’s decision of the lawsuit that sought to repeal New York's Driver’s License Access and Privacy Act, which allows undocumented immigrants to apply for and receive a driver’s license. Announced by the Department of Homeland Security and the Department of Labor announced major changes that will make it significantly tougher for employers to sponsor H-1B visas for qualified aliens. The changes require employers to pay significantly higher wages, narrow the types of degrees that can qualify an applicant, and shorten the length of visas for certain workers. The new rules are to be implemented within 60 days of publication in the Federal Register. The USCIS is forgoing the regular notice and comment period to ensure that no American workers are harmed by foreign workers during the country’s COVID-19 economic crisis. On November 13, the United States Citizenship and Immigration Services announced changes to the U.S. citizenship test that lawful permanent residents must pass to naturalize as U.S. citizens. The test was last updated in 2008. Applicants who filed their N-400, Application for Naturalization, before December 1, 2020, will be tested on the 2008 version of the civics test; and those who file after December 1, 2020, will be tested from the 2020 version. On November 18, the Department of Homeland Security and the United States Immigration and Customs Enforcement extended the flexibility in complying with Form I-9, Employment Eligibility Verification, due to COVID-19 until December 31, 2020. Employers are urged to monitor both the DHS and ICE websites for additional updates on flexibility extensions. The Form I-9 flexibility was initially announced by the DHS in March of this year as a step towards easing regulations during the COVID-19 global pandemic. The number of international students enrolled at U.S. universities fell by 43% this fall, according to a survey conducted in more than 700 schools. This is the largest decrease recorded by the Institute of International Education. Primary reasons for this are the ongoing pandemic and the recent changes to the U.S. immigration system, both of which dilute the zeal of aspiring students. The pandemic has only exacerbated the chaos for many international students who are in the midst of graduating. New Jersey state officials recently released 2,261 inmates, creating a 15% single-day drop in the state prison population. Releasing the inmates was a step by lawmakers to curtail the spread of the coronavirus in the prisons. Among the prisoners released, eleven tested positive for COVID-19. It is expected that 1,000 more inmates will be released in the coming months. On November 4, ICE in Newark arrested 88 of the inmates who had been released. All those inmates had criminal violations and were either offenders or convicted of serious crimes. Immigrant advocates from various organizations raised concerns about such detention during the pandemic. Legislation to grant a driver’s license to undocumented immigrants has been introduced in the Pennsylvania House of Representatives. If passed, this bill would enable many immigrants to legally apply for and receive a driver’s license. These non-citizens are otherwise unable to acquire a license due to the lack of Social Security number and legal status. Fifteen states and the District of Columbia currently allow undocumented immigrants to obtain a driver’s license. Last week, the Department of Homeland Security announced plans to expand the use of biometric data in determining family relationships for immigration purposes. ICE conducted a series of operations in July and August, arresting over 2,000 illegal immigrants from 20 counties. Around 85% of the immigrants arrested either had criminal convictions or had charges pending against them. The rest of those arrested already were subject to deportation orders. A Guatemalan undocumented immigrant who is identified as A.V. was on the verge of medical repatriation by Jefferson Torresdale Hospital to a country that is less able to help him. The repatriation has been averted, and A.V. has been moved to a long-term care facility in the Philadelphia region. On July 31, a Memorandum of Agreement was signed by the Department of Homeland Security, acting through the USCIS, and the Department of Labor to provide access and share information about immigrant and nonimmigrant petition records and the data contained within the Office of Foreign Labor Certification and Labor Condition Application databases. Very recently, the USCIS revealed for the first time that there are more than 580,000 of non-immigrant H-1B workers in the United States. On July 31, 2020, the United States Citizenship and Immigration Services published a final rule with a significant rise in its fee schedule. The new schedule has added new fees, establishing multiple fees for nonimmigrant worker petitions, and limiting the number of beneficiaries for certain forms. Additionally, the new rule removes certain fee exemptions, changes fee waiver requirements, and alters premium processing time limits. The new schedule is to take effect October 2, 2020.
