Since the beginning of the pandemic, I have fought tirelessly for the rights of patients, families, nurses and facility staff in long term care facilities, tryi...ng to make sure their needs are met and that they are kept as safe as possible during a global health pandemic. Senate Bill 1279, while well intentioned, fails on many levels to establish a safe, resident-centered process to designate essential family caregiver(s) in long term care facilities. On Monday I offered an amendment to SB1279, which would have addressed these shortcomings by allowing the resident or their responsible party to self-select their essential care giver and by explicitly providing for adequate PPE and rapid testing for residents, staff and visitors. However, the majority party did not value these additions that centered resident choice and safety, and the amendment failed to be adopted into the bill. Furthermore, the bill remains to be inconsistent with federal guidelines, and, if enacted, would be more restrictive than those current guidelines. Because of the inconsistency with federal guidelines, the absence of resident rights, and the lack of safety protections for residents, staff, and visitors, I ultimately voted no on the bill. I will continue to fight for resident rights in long term care facilities as well as reasonable and necessary safety precautions we all should be taking during a pandemic to protect our loved ones.
