Federal Judge in Illinois just vacated the public charge rule in it’s entirety stating that it violated the APA. Public Charge or Public Charge Test is used by immigration officials to decide whether a person can enter the United States and who is primarily dependent on the government for support. On Monday, July 7, 2020 Immigration and Customs Enforcement (ICE) announced International students in the United States must leave the country or risk deportation if their universities decide to only offer online courses. ICE said that students who fall under certain visas "may not take a full online course load and remain in the United States," adding, "The U.S. Department of State will not issue visas to students enrolled in schools and/or programs that are fully online f...or the fall semester nor will U.S. Customs and Border Protection permit these students to enter the United States." This could affect more than one million international students currently studying in the US. According to the Institute of International Education, the vast majority of those students came from Asian countries, with the largest numbers by some distance coming from China (369,548) and India (202,014). By contrast, only 26,122 came from Canada (in fifth place) and 15,229 from Mexico (in tenth place). New York City is home to the most international students, thanks to New York University and Columbia University playing host to 19,605 and 15,897 students respectively. A federal judge in Portland, Oregon, has temporarily blocked a Trump administration rule No Health Insurance / No Visa. The new rule would require immigrants to prove they will have health insurance or can pay for medical care before they can get visas within 30 days of their arrival or enough money to pay for reasonably foreseeable medical costs. The proclamation signed by President Trump in early October applies to people seeking immigrant visas from abroad, not thos...e in the U.S. already. It does not affect lawful permanent residents. It does not apply to asylum seekers, refugees or children. Under the government’s visa rule, the required insurance can be bought individually or provided by an employer and it can be short-term coverage or catastrophic. Medicaid doesn’t count, and an immigrant can’t get a visa if using the Affordable Care Act’s subsidies when buying insurance. The federal government pays for those subsidies. According to the Migration Policy Institute, a nonpartisan immigration think tank, 57% of U.S. immigrants had private health insurance in 2017, compared with 69% of U.S.-born, and 30% had public health insurance coverage, compared with 36% of native-born. The uninsured rate for immigrants dropped from 32% to 20% from 2013 to 2017, since the implementation of the Affordable Care Act, according to Migration Policy.
