Congratulations to my client from Romania who was released from prison today!! He has been detained since January for petty theft from a store in the amount of $200.00. He was previously arrested before for having a grinder containing marijuana but was only found guilty of disorderly conduct. Unfortunately his criminal attorney could not represent him on the petty theft because the Courts were closed and he could not appear. His first bond hearing was cancelled because of qua...rantine. He was denied bond at his second hearing because he was deemed a flight risk and danger to the community pursuant to the current law in the BIA even though I argued that there were exigent circumstances with the amount of detainees in his dorm that were sick. The We could file an appeal and wait months for a decision but his bond would be set at $45,000. His asylum application was due the following week but my client was afraid to continue his case. He wanted to go home especially after another detainee died from the virus. However, due to the travel ban in general I had no idea how long it would take for him to be deported. Because people are not allowed to work he was unable to pay me to file his Asylum application but I did it anyway just to preserve his rights and sent a copy with supporting documents to ICE/DHS. For the last two weeks where he was scheduled to the appear his hearings were cancelled. I just received a phone call that my client was released today on his own recognizance which means that he is FREE without having to pay any bond. He is finally free after THREE LONG MONTHS! Right now more than ever with this quarantine it is important for those who are essential workers be able to support their family! His Social Security Card is on the way! Congratulations to my client from Senegal who was approved for his 10 year green card yesterday!!! It is always wise to consult an attorney for immigration issues. This client had an agent, not a licensed attorney, improperly file an I-90 when he should have filed a Petition to Remove Conditions of Permanent Residency. Because the filing was incorrect he received a letter from USCIS that he would be placed in removal proceedings which could place him in Court, cost him thou...sands of dollars, and subject him to removal! We filed the proper I-751 with supporting documents and he was immediately granted an 18 month extension. His extension was set to expire next week so I wrote an official letter requesting another extension or approval. Guess it works to follow up in writing because he was approved! Congratulations to my client from Burkina Faso on his parole release from the Elizabeth Detention Center in Elizabeth, New Jersey! Freedom! We had received notice before that people at the Court (the prison is located inside the Court building) and the DHS office was closed due to the COVID-19 outbreak. A lot of prisoners and workers were getting sick. I just got off the phone with his son who is on his way to pick him up! My client passed a credible fear hearing, has no criminal history, but had visa issues when he got to the airport. Because he is an arriving alien the Court by jurisdiction could not grant him bond in a regular proceeding. Congratulations to him and thanks to everyone working behind the scenes in the govt that helped to make this happen!!!!!

My client is detained at Pike County prison. Three other detainees in his dorm tested positive for #Covid_19 Another female detainee died of COVID-19 within the last 24 hours. They are all sick. No more tests. I am going to file for bond w habeas and a BIA Appeal. Going to contact @ACLU to work together! Lord help us! The prison will not test anyone else because they claim they do not have tests. He is detained for stealing $200 he should not die for this. No one should!!!!

So now the federal government has to justify the massive release of detainees in prison due to everyone getting sick (including judges, DHS, and government employees) since they lost in federal court, and it got out that ICE is still deporting people abroad and putting them on flights which is antithetical to the idea that the virus should be contained and not transmitted across borders. Now the NVC and the embassies should process applications faster? For people from foreign countries to fly here to work? So it’s okay to travel now? I appeared at this Court for my client today. He called me last night scared because three other prisoners in his dorm were extremely sick with Covid-19 symptoms. Please make sure that you find an immigration attorney for a bond hearing or parole request so these detainees can be released before they all end up dying! Today we announced that we will reuse previously submitted biometrics in order to process valid I-765 (Application for Employment Authorization) extensions due ...to the temporary closure of Application Support Centers (ASC) to the public in response to COVID-19. Applicants who had an appointment scheduled with an ASC after the March 18 closure or filed an I-765 extension will have their application processed using previously submitted biometrics. This will remain in effect until ASCs resume normal operations. This announcement is consistent with existing USCIS authorities regarding the agency’s ability to reuse previously submitted biometrics.
