We would appreciate your assistance in circulating this broadly : PEAL has been contacted by families whose young adults were slated to age out of school serv...ices due to turning age 21 who were unable to receive the final months of instruction due to the COVID-19 school closures. We have been made aware that in order for this to be allowed, a change in the statutory school code language is needed. The legislature is meeting today and tomorrow to consider this change. While this does not affect a large number of students, it is very important that the students who are impacted be provided with services to make up the learning lost without needing to go to a hearing on an individual basis where compensatory education could be ordered on a case by case basis. We would appreciate your assistance in making PA legislators and officials aware of that families need this extension for their young adults. Pennsylvania employers and employees dealing with unemployment compensation claims during the coronavirus public health crisis face several unique considerations. Eligibility for unemployment compensation benefits is initially made by employees at UC Service Centers across the state. This determination is made based upon the initial paperwork filed by the employer and employee. Either party can then appeal the initial determination to a UC Referee, who makes his or her own de...termination after a hearing. Unfortunately, as a result of the public health crisis, all pending UC hearings have been canceled statewide. This means the initial decisions made by UC Service Centers will stand until hearings can be rescheduled or being to be scheduled again in the future. As a result, the thoroughness and accuracy of initial paperwork filed by employers and employees has taken on increased importance. While employees will generally be eligible for unemployment benefits where their unemployment is due to the coronavirus, accurate characterization of the separation in the initial claim form will be vital for employees to obtain benefits, which they can receive immediately as a result of the state's elimination of the typical one week "waiting period." Employer paperwork is equally critical if an employee's unemployment was caused by coronavirus--employers may obtain relief from charges where unemployment is due to COVID-19-induced business closure, which helps protect businesses from unemployment surcharges in the future. If the reasons for an employee's separation would preclude the award of benefits, employers will want to present a compelling case in their initial paperwork given the unknown wait time for an appeal hearing.
