Legal Alert from Lamb McErlane PC Chairman & Managing Partner Joel L. Frank: House Judiciary Committee approves constitutional amendment seeking to change judicial election process. A constitutional amendment seeking to change how Pennsylvania voters elect their appellate court judges is inching closer to submission to those same voters for a final decision. The state House Judiciary Committee on Wednesday (January 13, 2021) reported to the full House of Representatives legi...slation that would establish appellate court voting districts within the Pennsylvania Constitution, with the same language having already been approved by the General Assembly last session. A constitutional amendment must be approved by lawmakers during two consecutive two-year legislative sessions before it can be put to the voters as a ballot question; should voters approve, it would become part of the Pennsylvania Constitution. House Bill 38, like House Bill 196 last session, would divide the state into nine Commonwealth Court districts, fifteen Superior Court districts, and seven Supreme Court districts, with candidates for those judgeships required to reside in the district they seek to represent on the court. As with legislative districts, the judicial districts would be drawn so as to have populations as equal as possible, with compact and contiguous geographic boundaries, and comporting with the federal Voting Rights Act of 1965. Officer, Do You Have a Warrant? Pennsylvania Law on Searches of Vehicles Has Radically Changed. Article by Lamb McErlane PC partner Dan Bush. Police roadside searches of vehicles just became more difficult for law enforcement in Pennsylvania. On December 22, 2020, the PA Supreme Court handed proponents of individual privacy rights a major victory when it narrowed the right of law enforcement to conduct roadside searches of automobiles in PA. In Commonwealth v. Alexander, th...e Court held that warrantless vehicle searches require BOTH probable cause and exigent circumstances and that law enforcement may no longer rely on the inherent mobility of a vehicle (recognized under federal law) as an exigent circumstance to permit warrantless searches based on probable cause. Now, where law enforcement only has probable cause to search a roadside vehicle, and no exigent circumstances are present, a search warrant must be secured. Wheeling Hospital, Inc., a 223-bed acute care hospital located in Wheeling, West Virginia, is the latest facility to be dinged by the Department of Justice (DOJ). The hospital, which has several subsidiaries and a physician network, has agreed to pay the federal government $50 million to resolve allegations that it violated the False Claims Act by knowingly submitting claims to Medicare that resulted from violations of the Physician Self-Referral Law and the Anti-Kickback Statute.
