The devices and accounts we use to conduct business, share information and communicate with each other can be protected by a variety of password forms, ranging from number/letter combinations to biometric markers. In the legal context, courts are divided as to whether an individual can be compelled to disclose such password information. Recently, a federal court has found that an individual cannot rely upon the Fifth Amendment (right against self-incrimination) to refuse to provide facial recognition necessary to unlock his computer. Our August Insight post explores this developing topic: https://insights.bit-x-bit.com//evolution-of-the-fifth-am/

Even before COVID-19 forced most of the business world into remote work settings, organizations facing litigation or other legal demands had a growing need to defensibly and efficiently collect electronically stored information located across diverse geographic locations. With an increasingly remote work force, the ability to forensically collect data from mobile devices, personal computers or online/cloud storage accounts can be expected to rise. Partnering with a service p...rovider who has methods in place to maintain the integrity of the data will help avoid charges of spoliation and will ensure that such data can be authenticated, if needed, in ongoing legal proceedings. Brett Creasy, bit-x-bit’s President and Director of Digital Forensics, and John Unice, the firm’s General Counsel and Executive V.P., discuss the in’s and out’s of remote data collection in the August 28, 2020, issue of the Allegheny County Bar Association’s Lawyers Journal. With the dramatic rise in document review costs as more and more electronic data is created in the ordinary course of business, technology is increasingly necessary to manage the process and associated expenses. The use of such technology, including technology assisted review (TAR) is becoming more commonplace in the discovery process, no matter the size of the of the case or investigation. Not only can TAR quickly identify potentially relevant documents and materials, it can also be used to speed up and enhance the efficacy of the privilege review, giving clients and counsel significant peace of mind and resulting cost savings.
