Admittedly, this story is only tangentially related to bankruptcy law, but the chutzpah of this guy is remarkable.
Boards of Directors may need to think twice (or 10 times) before selling a company that has a good chance of going bankrupt.
I'm not sure how much sympathy the NRA will get by complaining about the "corrupt political and regulatory environment" of New York, particularly where internal corruption was the cause of its bankruptcy.

Hard to give this legislation a passing grade. Unless it gets revised, those businesses that received PPP loans will not only be able to exclude the forgiven portion as income, but also deduct it as an expense. Quite the windfall.
The bankruptcy hits just keep on comin' in the retail clothing sector.
Despite the expected deluge of consumer bankruptcies, so far it has not come to pass and many are wondering why.
I think this would be a big deal if it is ultimately passed.
Another terrible shame. I personally liked this store. But the retail landscape is changing rapidly...not for the better.

In my February 2020 newsletter, I provided a brief explanation of The Small Business Reorganization Act of 2019, enacted on August 23, 2019, which added a new Subchapter V to Chapter 11 of the Bankruptcy Code. So why am I discussing the same topic just a few months later? Well, there are two reasons. First, the Act went into effect on February 19, 2020. So, there are some real world examples now. Secondand more importantly, a pandemic affecting nearly every nation on earth h...as hobbled the world economy and small businesses in particular. We’ve all witnessed chapter 11 reorganization filings by large retailers J. Crew, JC Penney, Neiman Marcus, and most recently Brooks Brothers, to name a few. The nosedive in natural gas and oil prices has also triggered a number of producers and refineries to file for chapter 11 protection. I still have some tokens from 35 years ago. I think I can still use them. In all seriousness, though, this highlights the problem of private equity firms gobbling up companies and loading them up with debt so that they cannot withstand a prolonged drop in revenue.
