FOR IMMEDIATE RELEASE December 17, 2020 Department of State Releases COVID-19 Enforcement Actions, Dec. 6-13... Harrisburg, PA The Department of State’s Bureau of Enforcement and Investigation (BEI) today released data related to COVID-19 enforcement actions from Dec. 6 through Dec. 13. With COVID cases increasing across the commonwealth, the Department of State is continuing with compliance enforcement as it relates to the regulated boards and commissions. The information is specific to COVID-19 mitigation requirements for the licensed professions, including social distancing, masking and occupancy limits. These numbers include actions taken during routine inspections and investigations prompted by consumer complaints. From Dec. 6 through Dec. 13, BEI performed 496 total inspections and opened 16 investigations during which COVID-19-specific compliance was a focus. This week, the Bureau distributed three warning letters and one compliance letter relating to COVID-19 mitigation efforts. BEI follows an education-first model and works with the Department of State’s Prosecution Division to educate and correct on-site before taking official action. Businesses unwilling to correct on-site will first receive a compliance letter issued by the Department to inform a licensee of a current and ongoing violation of the law, regulation or order and instructing them to immediately correct or otherwise remedy the practice that is the source of the violation as an alternative to formal prosecution of the matter. Following the compliance letter, inspectors will conduct unannounced inspections to ensure compliance or to document failure to comply as necessary. Failure to comply may result in the filing of formal charges by the Prosecution Division. The Department issues a warning letter to notify a licensee of a violation of the law, regulation or order that occurred in the past and is not currently ongoing. A warning letter is issued only after the investigation is considered complete and closed. COVID-19 mitigation enforcement actions will be released on a weekly basis. Consumers with complaints or concerns about non-compliance for COVID-19 mitigation may file a complaint online. The Department of State form is for complaints specifically related to the areas that the Department regulates, including licensed professionals and certain facilities. PLEASE NOTE: Professional liability insurance and the child abuse Act 31 course are the 2 biggest hold ups of renewals that have been submitted and paid for, but are still pending. Liability insurance is a condition of licensure, not a condition of practice. If upon renewing a license, the licensee answered no to the question about liability insurance, a hold was placed on the renewal not allowing it to process. In order for the process to finish, a copy of the insurance declaration page or statement that the question was answered incorrectly in error will need to uploaded to the renewal file. If the licensee is unable to do that, the information can be emailed, however, that will be a longer process. Likewise, the Act 31 course must be on file for the renewal to finish processing. That course must be completed for EVERY renewal and must be received direct from the sponsor of the course. If a licensee received an email telling them that the State Board does not have record of the Act 31 course and the course has already been completed, the licensee must contact the sponsor to make sure the information being sent is correct-first name, last name, license number, date of birth, and last 4 of the ssn must match the information in the State Board's system. On November 17, 2020 the Pennsylvania Department of Health issued a Universal Face Covering Order for Pennsylvania. Below is an excerpt from the order. The complete DoH order is attached for your careful review. This order supersedes all previous face covering orders, except where noted within the order.... Section 2: Face Coverings Required Except as provided in Section 3, every individual, age two and older, in the Commonwealth of Pennsylvania shall wear a face covering when: A. Indoors or in an enclosed space, where another person or persons who are not members of the individual’s household are present in the same space, irrespective of physical distance. B. Outdoors with others who are not members of a person’s household and unable to maintain sustained physical distance. C. As permitted in my Order Directing Mitigation Measures, dated July 15, 2020, as amended, for participation in an indoor or outdoor event, gathering, or group setting where another person or persons, who are not members of the individual’s household are present. D. Participating in indoor physical activity in a gym, fitness center or group fitness classes, where another person or persons who are not members of the individual’s household are present in the same space, irrespective of physical distance. E. Waiting in a public area for, riding on, driving or operating public transportation or paratransit or while in a taxi, private car service or ride-sharing vehicle, irrespective of physical distance. F. Obtaining services for themselves or another person or a pet from the health care sector in settings including, but not limited to, a hospital, pharmacy, medical clinic, laboratory, physician or dental office, veterinary clinic, or blood bank. G. When working in any space where food is prepared, packaged for sale, or prepared for distribution to others. I. Certain facilitiesincluding hospitals, shelters, long-term care facilities, residential treatment facilities, and correctional facilitiesmay also require visitors and residents, patients, or inmates to wear face coverings even when in a living unit.

ONLINE ACRRT Primer for Chiropractic staff who wish to take X-rays in PA! To those who plan on taking the upcoming ACRRT test on November 21, 2020 in Altoona: Dr. Victor Rizzo is offering two Zoom classes for chiropractic staff that desire to take the upcoming ACRRT exam in Altoona on November 21 at 9:00 AM. One class will be primarily for those who have not taken his Primer course. The other class will be a review before the test. Staff can take one or both courses.... Due to COVID concerns and to reduce the cost of travel to offices, chiropractic staff can, from the convenience of their home computer or cell phone, take these courses. To take a course it is required that staff purchase the ACRRT Study Guide from http://www.acrrt.com//content/article/7-acrrt/11-acrrt-stu and register for the PA Limited Exam at http://www.acrrt.com/index.php/examination Must register for exam at least two weeks in advance. The 4-hour Zoom ACRRT Study Guide seminar will be on Saturday, November 7, 2020 from 8:00 AM-12:00 PM. The cost is $99/person. The 2-hour Zoom Test Review Course will be Tuesday, November 10, 2020 from 7:00 PM-9:00 PM. The cost is $49/person. Payment must be made prior to the dates above and can be made by sending a check to Dr Rizzo at address below or by his office taking a credit card over phone at 814-944-3536. The Chiropractic Practice Act in PA states that all staff that take X-rays must have passed the ACRRT exam or the medical X-ray tech exam.
