Have you ever seen the movie Money Pit with Tom Hanks?? When ever I watch it, I always get a good laugh!! Well, if Money Pit is how you are describing your new home, you won't be laughing. In fact you could be in serious trouble if stuck with a money pit. I can't count the times people ask what recourse they have, once they realized they bought the money pit. And I always answer with "it depends". Here are some of the factors... 1. How long have you had the home? Statute of ...limitations are typically 1 year. So if it is less than a year you may have some recourse. 2. Who was your home inspector and did he/she have the proper insurance. Pennsylvania law requires Home Inspectors to carry errors and omission policies with a minimum of of not less than $100,000 per occurrence and $500,000 in the aggregate and with deductibles of not more than $2,500. 3. Did you receive photos from the home inspector. Some times the defects were visible in the pictures. Proving that the defect was present at the time of inspection So if you want to avoid "The Money Pit" make sure you hire an inspector with lots of time and experience in real estate. And make sure they have the proper insurance!! See more
