York Housing Opportunity Center 31.01.2021

The Lancaster Housing Opportunity Partnership want to conitinue their efforts to educate the public regarding the eviction process in Pennsylvania. Please note the information presented in these posts is not legal advice, and the client should consult with a lawyer for specific information on their case. Following the Notice of Judgment, a tenant will have ten (10) days to file an Appeal. You have the right to appeal a judgment entered against you. Appeals are filed with the ...Prothonotary at the Court of Common Pleas. To appeal a decision by a Magisterial District Court, you will need to bring a copy of the judgment with you to the Prothonotary’s office. It is advised that you seek the counsel of an attorney if you chose to file an Appeal, as the process at this court level is more complicated. If you are appealing a Judgment for Possession and want to stay in your home, you have ten (10) days from the judgment date to appeal the decision. You must also file a Supersedeas to stop the sheriff or Constable from removing you from the property. If you do not tell the Prothonotary’s Office that you want to stop the lockout and do not file a Supersedeas, then you will only be appealing the money judgment, and the lockout will still occur as scheduled. If you do not want to appeal a Judgment for Possession, but only want to appeal the money judgment, you have thirty (30) days from the date of the judgment to appeal. The Centers for Disease Control and Prevention (CDC) has established an eviction moratorium, which protects tenants from being evicted until the end of March 2021. Tenants need to meet specific criteria and sign a declaration to give to their landlord to qualify for this protection. If you have questions, reach out to our offices for assistance. On December 27th, a federal bill was signed into law, providing additional COVID-19 relief funds for the Fiscal Year of 2021. This bill includes $25 billion in rental assistance and an extension of the CDC Moratorium until January 31, 2021. Last week, the Supreme Court of Pennsylvania modified the eviction process to take effect on January 1, 2021. With the end of the CDC Eviction Moratorium quickly approaching, these modifications will allow and encourage landlords to continue to work with their tenants toward payment plans. In a traditional eviction case, if the courts rule in favor of the Landlord, the Landlord must wait 10 days to file for an Order of Possession which is the legal process that schedules t...he removal of a tenant from the property. After the 10 days, the landlord has 120 days to file that order, if they do not file the order of procession within 120 days, they must go through the court process of eviction again, spending more time and money. These modifications would allow 180 days, after the initial 10 day waiting period, for the Landlord to file an order of procession. The supreme court is hopeful that this will provide the parties with greater flexibility to negotiate and enter into private forbearance agreements. The Second modification made is, the extension period of a landlord’s ability to file an order of procession. Under these new ruling a landlord will be able to request written reissuing of an order of procession twice for 60 days each. In total this will give the parties 300 days to work towards a forbearance plan with out having to return to court. The York Housing Opportunity Center is delighted to welcome Enicel Enriquez as our new Homeowner Specialist. Enicel grew up in Brooklyn New York and came to Lancaster County in 2004 with her family. Since then, she has called Lancaster her home. Enicel has a Specialized Associate Degree in Business Operation Management from YTI Institute. From 2016 to 2018 she worked for Lancaster County Redevelopment Authority... (Section 8 Department) as a Tenant Coordinator. She will be bringing her valuable bi-lingual skills in English and Spanish to her role at the York office. This will allow for greater outreach and communication with the vibrant Latino community throughout York county. Enicel looks forward to adapting her experience and training to assist the York Community in their journey to homeownership.
