During the 2018 federal government shutdown, USCIS applications should not be affected as the processing is funded by the filing fees paid by applicants. Removal proceeding hearings for non-detained persons will likely be continued to a future date. During the last government shutdown, there was a skeleton staff at EOIR (Immigration Court) and Office of the Chief Counsel. If you have an upcoming hearing, we will be in touch with the Immigration court to determine if your cas...e will proceed as scheduled. The following is an American Immigration Lawyers Association (AILA) advisory: Practice Alert: What Happens if the Government Shuts Down? AILA Doc. No. 17042640 | Dated January 19, 2018 Congressional negotiations on a federal spending bill remain very active. To avoid a federal government shutdown, a decision or a short-term continuing resolution (CR) to fund the government at current levels must be reached by Friday, January 19, 2017. Until a deal is made or a CR is passed, the threat of a shutdown remains a possibility. Drawing on information from past government shutdowns, AILA provides an overview of how a shutdown may impact immigration-related agencies. We will update this practice alert if new information becomes available. Generally, if the government shuts for budgetary reasons, all but "essential" personnel are furloughed and are not allowed to work. USCIS: USCIS is a fee-funded agency with the exception of E-Verify, so if the government shuts down, only E-Verify shuts down. Otherwise, it's business as usual. DOS: Visa and passport operations are fee-funded and should not be impacted by a lapse in appropriations, but operating status and funding will need to be monitored closely. If visa operations are affected, consular posts will generally only handle diplomatic visas and "life or death" emergencies. CBP: Inspection and law enforcement personnel are considered "essential. Ports of entry will be open; however, processing of applications filed at the border may be impacted. ICE: ICE enforcement and removal operations will continue, and ICE attorneys will typically focus on the detained docket during a shutdown. The ICE Student and Exchange Visitor Program (SEVP) offices are unaffected since SEVP is funded by fees. EOIR: EOIR's detained docket is typically considered an essential function and would therefore continue to operate. During the 2013 shutdown, EOIR continued to accept court filings, even in non-detained cases. DOL: The OFLC would cease processing all applications in the event of a government shutdown, and personnel would not be available to respond to e-mail or other inquiries. OFLC's web-based systems, iCERT and PERM, would be inaccessible, and BALCA dockets will be placed on hold. CIS Ombudsman: The DHS Office of the CIS Ombudsman would close and would not accept any inquiries through its online case intake system.

I’ve noticed something distinctive about the character of many of my immigrant clients. They are survivors and doers -- scrappier, more resilient, more optimistic, more innovative, and more likely to take risks. We’re talking about a group of people who will pack up a handful of possessions in the middle of the night, leaving behind everything that is familiar and everyone that they love, to escape religious persecution and/or bone-crushing poverty. They risk drowning by sea,... dehydration in the desert, rape by smugglers for the chance to live in a country where they can feel safe for once, where their hard work is rewarded and where their children can study and have a real shot of becoming . . . an attorney, an editor or a doctor within one generation. My own parents’ coming-to-America journey was not nearly as perilous, but their struggle while successfully raising 3 daughters in the United States is shared among many immigrants. #AmericaIsAlreadyGreat because everyone who lives in this country had or is descended from someone who had the mettle to risk everything to come here. This is President Trump's DRAFT Order Regarding DACA and the rescission of Former President Obama's June 15, 2012 memorandum, entitled "Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children." This is not yet official. If President Trump signs and releases this order, DACA employment authorization documents (i.e. work permits) will remain valid until the expiration date listed on the cards. What is happening with DAPA? The Supreme Court may choose to move forward and hear oral arguments scheduled in April 2016 and then issue a decision in June 2016. If the outcome is favorable for the immigrant community, implementation of DAPA and expanded DACA would begin before the end of Obama’s term. If the court comes to a 4-4 vote, the lower court’s ruling of an injunction will stand. The court may also decide to hold off on making a decision until a new justice is appointed in place of Justice Scalia.
