History is an academic discipline. It is not simply what you wish the past to have been and to have meant. https://heathercoxrichardson.substack.com/p/july-9-2021-a52

Not unlike local police, DHS works for us, the People. DHS neither can do its job now nor is it any longer redeemable. It is so profoundly corrupted and politicized. Its current personnel have become tools. There is simply no going back. We need to dismantle and reform its various functions to truly protect the American people and our common shared human interests. The use of the term 'homeland' from the first I heard it after 9-11 felt paranoid and small to me. The term is i...tself divisive, false and particularly un-American. It is more nativist than inspirational, as it fails to call out to our better angels, something we currently deeply lack. The covid-19 pandemic, the long-term threat to U.S. infrastructure from climate and weather changes, and the increasing non-kinetic actions by nation-state adversaries in 2020 that seek to undermine U.S. power, all point to the need for the United States to make another fundamental change in how the U.S. government defends the nation and keeps the American people safe, the report states. With input from more than 100 former DHS leaders and security experts, the report the first published by the Scowcroft Center since the death of retired Air Force Lt. Gen. Brent Scowcroft last week points out that the coronavirus pandemic has been killing approximately as many Americans as died on Sept. 11 every four days."

It's endless- but we must not relent in resisting this Administration. ____________ "Depending on the issue and its perceived electoral implications, COVID-19 is either a benign nuisance over which the country must stop fretting, or a catastrophic national emergency that presents an imminent and severe risk to everyone. Perhaps most alarming, what unites these otherwise irreconcilable positions is that the disparate policies and practices they seek to rationalize unnecessari...ly put people’s health and well-being in additional jeopardy. The country is facing actual security threats both at home and abroad from racially motivated police violence, to the Russian/Taliban bounty operation, to the militarized suppression of dissent. Torture survivors and victims of other forms of persecution seeking safe haven in the United States is not one of them. The president’s obsession with the latter coupled with a malevolent indifference to the former isn’t about national security or public health. It’s about who will sit in the Oval Office come January." https://www.justsecurity.org//trumps-latest-assault-on-as/

This is a relief and super good news! This is great.... as it protects for the moment many clients and people super important to our firm. And yet-- it's just another example of how close we all are to a very scary use of power in extreme reactionary ways. But for Trump's utter ineptitude and stupidity, we have a momentary reprieve. This is not a decision that Trump cannot ever legally end protection for the Dreamers... It's a decision that states only that he didn't do it c...orrectly. He did it in a way that was unjustified. It's possible to redo it the effort to rescind it. That Trump was ineffective and hapless and dumb and sloppy does not mean that they will not try it again and again. And more importantly long term, there will be a future Trump in the White House and unless we have effective statutory limits in place--- We all will be harmed. We need a Congress that can pass laws to protect us and fix the laws (like the INA- Immigration and Nationality Act) that are broken. DACA was a band-aid. Obama was not able to fix our immigration system due to Republican refusal to consider any changes, so he was forced to resort to the band-aid as a temporary form of relief. We need to do better. That I know personally of immigrants who have voted Republican -- and many more who simply cannot be bothered to vote or even naturalize--this is directly part of the problem. The Republican party has used Immigrants and fear of immigration as a race-based means to attain power. This is incontestably true. The rest of the problem is our lazy and somewhat racist and/or xenophobic friends, family, neighbors and colleagues. All of this means we have a lot of work to do. Just like the Bostock case around LGBT employment, where we got a partial and limited victory, this is only a temporary reprieve. We are getting here the caliber of governance we can be bothered to fight for. Get the hell up off your coach. Get moving. November is coming sooner than we think. https://www.supremecourt.gov/opinions/19pdf/18-587_5ifl.pdf See more
