Yesterday afternoon my office filed a lawsuit to Set Aside the Nomination Petitions of Stevie Jones, candidate for the democratic nomination for Mayor of the City of Allentown. 2021-C-0609. Mr. Jones has made it known that he intends to withdraw from the race. However, as of yesterday afternoon he had not filed the appropriate paperwork with the Lehigh County Board of Elections. Accordingly, we are continuing our lawsuit until he has either formally withdrawn or our Petition is granted, whichever comes first.

My office is preparing to file a challenge to an Allentown Mayoral candidate's nomination petitions. We are hearing that, facing our suit, he is expected to withdraw before our petition is filed. In either event, we expect this to narrow the race to four candidates.

Today we scored a victory for Pennsylvania workers who are retaliated against by their employers for lodging complaints about the employer's failure to adhere to COVID-19 safety protocols as dictated by the Governor and Secretary of Health. Judge Pavlack at the Lehigh County Court of Common Pleas found a possible public policy exception to the at-will employment doctrine in such circumstances. #employmentlaw #covid

On Tuesday, December 8th, I, Matthew Mobilio, will stand before a judge of the Court of Common Pleas of Northampton County and defend myself for adhering to one of the most important tenets of the practice of law... "To pursue a matter on behalf of a client despite opposition, obstruction or personal inconvenience to the lawyer, and take whatever lawful and ethical measures are required to vindicate a client's cause or endeavor." My alleged impropriety? Withdrawing a claim d...ue to my client's inability to prove their claim without a material witness being present and attempting to reschedule the hearing for when the witness is available. The legal system is broken but we will never stop putting all we have into the representation of our clients.

Mobilio Wood represents two women who were sexually assaulted by a manager of Longhorn Steakhouse, which is owned by Darden Restaurants. The suit is currently in federal court. See Jane Doe 1 and 2 v. Darden Restaurants, 3:20-cv-0862-JPW. However, Darden is trying to force the matter into a binding arbitration. Forced arbitrations, such as the one at issue, discourage companies like Darden from working to eliminate, or at least minimize the occurrence of sexual harassment... and assault from occurring in the workplace. Darden was involved in the most arbitration cases at the American Arbitration Association (AAA) between 2014 and 2018, for a total of 329 employment arbitrations. Of those 329, employees won awards in only 8 of those cases for a total recovery of $73,961.00 . Darden’s prior success is unrelated to the merits of their opponent’s cases. A recent study by the AAA and JAMS two of the nation’s primary arbitration providers revealed that employees prevail in less than 2.5 percent of filed arbitrations. Accordingly, Darden has enjoyed a total lack of financial impact, despite hundreds of potential claims being brought against it during the aforementioned period. In the absence of negative financial impact, only negative public opinion could theoretically encourage Darden to enact strong anti-harassment measures. However, because arbitrations occur in private, testimonial and documentary evidence, allegations and rulings rarely see the light of day. Accordingly, the extent to which there exists or existed sexual harassment and/or assault at its restaurants and Darden’s efforts and effectiveness at deterring same are unknown to the public at large. Moreover, this disincentive to enact and enforce strong anti-harassment policies, in combination with the secrecy of arbitrations, exposes current and future employees of Darden to increased risk of being assaulted and/or harassed. Darden’s 97% success rate at private arbitrations encourages them to make hiring and disciplinary decisions based exclusively on corporate profits, without regard to potential exposure to lawsuits and negative publicity. Accordingly, a harasser’s financial benefit to the company will almost certainly outweigh the veracity of the allegations of lower wage workers. In addition, in the absence of publicly available information regarding the existence and extent of sexual harassment and assault at Darden Restaurants, current and future employees are unable to make an informed decision as to whether employment with Darden is a safe choice. Therefore, a current or prospective employee may be exposed to and work closely with a manager or co-worker who has been accused on one or more occasions of harassment or assault and have no way of ever knowing. light of day. Please share this post to expose companies, like Darden, who use arbitrations to silence victims.
